DECRETO LEY Nº 09758

C O N S I D E R A N D O:

Que, es indispensable actualizar el Arancel de los Registro de Derechos Reales, a fin de evitar mayores pagos y exacciones al público y fiscalizar debidamente los recursos correspondientes;


QUE, DESDE LA VIGENCIA DEL ARANCEL GENERAL APROBADO POR DECRETO SUPREMO DE 28 DE ENERO DE 1938, NO SE HA PROCEDIDO A UNA REGULARIZACIÓN DE DERECHOS EN LA MATERIA Y QUE ES NECESARIO ACTUALIZAR A FIN DE QUE LAS DEPENDENCIAS DE LAS OFICINAS DE LAS CORTES SUPERIORES DE JUSTICIA DEL PAÍS, SEAN MODERNIZADAS, A CUYO FIN ES NECESARIO ESTABLECER RENTAS ESPECIALES Y PROPIAS PARA EL PODER JUDICIAL EN CUMPLIMIENTO A LO DISPUESTO POR LA LEY DE 27 DE DICIEMBRE DE 1967 Y ARTÍCULO 119 DE LA CONSTITUCIÓN POLÍTICA DEL ESTADO, DE ACUERDO AL ESTUDIO REALIZADO POR LA EXCELENTÍSIMA CORTE SUPREMA DE LA NACIÓN.-
EN CONSEJO DE MINISTROS,

D E C R E T A:


ARTÍCULO 1.- En sustitución de todo derecho o tarifa actualmente vigente, se establece el siguiente Arancel de derechos para las oficinas de Registro de Derechos Reales de la República:
Inscripciones preventivas o definitivas
cuyo monto alcance hasta la suma de $b. 20.000.­ $b. 20.­
