DECRETO SUPREMO Nº 28160

PRESIDENTE CONSTITUCIONAL DE LA REPUBLICA

CONSIDERANDO:

Que los Artículos 168 y 173 de la Constitución Política del Estado establecen que el Estado tiene la obligación de planificar y fomentar el desarrollo económico y social de comunidades campesinas, y, conceder créditos de fomento a los campesinos para elevar la producción agropecuaria.


QUE EL ARTÍCULO 165 DE LA CONSTITUCIÓN POLÍTCA DEL ESTADO INDICA QUE LAS TIERRAS SON DE DOMINIO ORIGINARIO DE LA NACIÓN Y CORRESPONDE AL ESTADO LA DISTRIBUCIÓN, REAGRUPAMIENTO Y REDISTRIBUCIÓN DE LA PROPIEDAD AGRARIA CONFORME A LAS NECESIDADES ECONÓMICO­SOCIALES Y DE DESARROLLO RURAL.-
Que la Ley Nº 1715 de 18 de octubre de 1996, Ley del Servicio Nacional de Reforma Agraria, establece que el Ministerio de Desarrollo Sostenible es parte del Servicio Nacional de Reforma Agraria.


QUE LA LEY Nº 2446 DE 19 DE MARZO DE 2003, LEY DE ORGANIZACIÓN DEL PODER EJECUTIVO, EN SU ARTÍCULO 4 ESTABLECE COMO UNA DE LAS ATRIBUCIONES DEL MINISTRO DE DESARROLLO SOSTENIBLE: "FORMULAR LA POLÍTICA NACIONAL DE TIERRAS" Y, EL DECRETO SUPREMO Nº 27732 DE 15 DE SEPTIEMBRE DE 2004, READECUACIONES AL REGLAMENTO DE LA LEY DE ORGANIZACIÓN DEL PODER EJECUTIVO, EN SU ARTÍCULO 20 ESTABLECE COMO UNA DE LAS FUNCIONES DEL VICEMINISTRO DE TIERRAS "DISEÑAR POLÍTICAS Y PROGRAMAS ...
